Reserve Clauses Clarity<\/strong><\/span><\/h1>\n

Covid Crisis Reveals Need for Long Overdue Reform<\/em><\/strong><\/span><\/p>\n

The simplest way of explaining the concept of our original federal government is through the lens of our Constitution. \u00a0It is one of subordinate powers\u2026 with limited functions and purpose.\u00a0 Each branch was expressly created within the confines of these limited rules and conditions.\u00a0 Remember, the Constitution represented the States\u2019 desire to create a subordinate set of guidelines that would promote a homogeneous domestic environment and project a unified national front.<\/p>\n

At the end of the Constitutional Convention, several prominent members voiced concerns that certain rights were not enumerated and identified.\u00a0 Even though they all knew that these rights were implied, their farsightedness caused them to recognize that future generations might not get their implications.\u00a0 So they delineated and included them in what we now know as the Bill of Rights\u2026 so future generations would have clarity.<\/p>\n

The first eight amendments created a clear and specific enumeration of several key limits to the new government\u2019s power and reach\u2026 and as importantly\u2026 the ninth and tenth amendments included more general language, which made the scope of their intentions as encompassing as possible.<\/p>\n

Their intentions were that this Constitution delineate a SUBORDINATED AND LIMITED form of government\u2026 to promote domestic tranquility and project a legal and united front to the rest of the world. \u00a0It was never intended to run the daily lives of \u2018We the People\u2019 within their political jurisdictions (States).<\/strong><\/p>\n

The Reserve Clauses<\/span><\/h2>\n

The ninth and tenth amendments to the U.S. Constitution are generally referred to as the Reserve Clauses.<\/p>\n

The Ninth Amendment language is simple and general.\u00a0 It states\u2026<\/p>\n

\u2018The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people.\u2019<\/em><\/p><\/blockquote>\n

This was a compromise amendment created and inserted as a safety net to annotate unspecified or unenumerated rights\u2026 in other words, all those not named yet protected and retained by the people.<\/p>\n

The Tenth Amendment\u2019s language is also simple but more direct and specific\u2026<\/p>\n

\u2018The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.\u2019<\/em><\/p><\/blockquote>\n

Both of these amendments emphasize that the inclusion of a bill of rights does not change the fundamental character of the federal government\u2026 it remains a government of limited, enumerated and subordinated powers\u2026 with all other rights reserved and retained by \u2018We the People\u2019.
