WHEN IS JURISDICTION GOING TO MATTER?

States Need to Re-assert Their Superior Constitutional Role

 

America today is in crisis… I’m sure we can all agree on that.

Did we suddenly arrive here?  Or, is this the result of circumstances beyond our control?
Neither… actually.
And here’s the good news… its fixable… and fixable relatively quickly…
BUT… are you willing to do the few simple steps to make it happen?
Let’s look at where we are before you decide.

 

America’s current generations have inherited a system of government with severe problems, and for a myriad of unexplainable reasons… the political leadership has not deemed it important to deal with IT.

So, here we are… in a state of crisis… it’s time to deal with IT or implode, because the current path is unsustainable.

 

What IT is…

The IT we’re talking about is a severely fractured Federal system of government that has been steadily slipping deeper into bloat, inefficiency and crippling, unsustainable debt…by all accounts, it has not been managed well at all.

  • Citizens from each state have not… and are not being represented well.
  • States have steadily relinquished their power and control to this bloated federal system…
    so they have not… and are not being represented well.

So… where does that leave the people of each State of our union?

Feeling frustrated… ignored… growing more resentful and angry by the day.  AND our citizens have a right to feel this way… because the political leadership in our country has been promising to deal with these issues for several generations… and they have not done so… actually they’ve continually added to the problems.

 

Unique Jurisdictional Process

America is governed by a very unique system of representative government that allows for citizen control over the various forms of representation.  It WAS structured for direct citizen input and control.  It provided for balanced and limited power, disseminated over three branches… each with limited, specific responsibilities.

AND the key, working provision was a creation by the States at the Constitutional Convention… of a limited Federal (collective) system —a committee of the whole, if you will— a uniquely separate jurisdiction where proposals, discussions, debates and consensus on how to create and manage processes that would benefit all of the States could be discussed and actualized.

That unique process has been corrupted… and has been inflated beyond anything the founders envisioned.  Because of States’ abdication, this federal process has been given powers and authorities well beyond the scope originally enumerated in our Constitution.  So much so… that the distinct jurisdictional lines have been blurred… creating a nightmare of clamoring agencies vying for power and control.

My decades of watching and listening has shown me that we —the citizens— can fix this… IF we are willing to devote some time and honest, heartfelt attention to these problems.

BUT… before we can come to agreement of what to do, we should all be on the same page in understanding what we inherited… what our role is… and how stepping up and accepting our role of doing our part in managing our representative form of government is the right solution.

So… let’s start at the beginning… (of our country).

 

A Brief Historical Reflection on Our Constitutional Republic

The Constitutional Convention of 1787 produced a consensus document that has been generally followed by every generation since its inception.

This consensus document uniquely created a separate jurisdiction that provided the framework for States to come together and create agreements and guidance… that would then be disseminated —through their State representatives— and incorporated on a State level in their States’ legal process… either as State Statutes or incorporated in their State Constitutions.

The founders created this mechanism of the inferior Federal (collective) jurisdiction to interact with the Superior States’ (individual) jurisdictions… it was created by the Superior States as a subordinate mechanism to shuttle general principles necessary to maintain unity and order… a specific and limited portal between jurisdictions.

As such, the individual States are the Superior Legal Authority that created the Inferior Federal Jurisdiction that would be used to facilitate their generation and future generation’s progress and growth.  The written, ratified Constitution, and its Amendments, specifically spells out this inferior jurisdiction’s limits… complete with its own official, limited operating area… the District of Columbia. The founders were very specific and cautious in creating this entity… as their generations had experienced runaway superior jurisdictional issues with the British monarchy.  They wrestled with the concept and creation of a body that would have enough power to collectively manage itself… without becoming an entity unto itself that could become self-fulfilling… which is exactly what happened at the hands of the aggressive, control-minded, re-constituted political party system.

 

Validation of Colonists Sovereignty

According to the Treaty of Paris 1783 —that officially ended our first civil war— all right, title, and interest in the former British Colonies were transferred to the inhabitants of the several States.

This officially transferred ownership to all of these citizens… legally making them owners of their particular State… instantly putting them on equal status as the King of England… making them Sovereign Owners… the highest authority of ownership and control.

King George III unknowingly, instantly, created the de facto Treaty Of Paris 1783 CO-OP…
the largest CO-OP in human history…
where each person now had an ownership share, and a say, in every aspect of the lives and future.

 

As sovereign owners, these citizens had complete control over their lives, over their interactions with each other within their States, over their interactions with other States and other Countries…  AND a not-so-obvious consequence to the colonists of this transition was that with this great power came serious management responsibilities.

 

Critical 4 Years

The most dangerous time for these newly minted Sovereign States and their Sovereign Citizens was that time period between this Treaty of 1783 and the Constitutional Convention in 1787.  That 4 year period was legally, culturally, and financially fraught with apprehensions, misunderstandings, and conflicts around how to navigate their newly acquired status, positions of authority, and treaty requirements.

The colonists were in limbo… still reeling from the unimaginable military victory… free of British constraints… and adrift in a world of predatory nations looking for their next conquest.  They had an ineffective Continental Congress… no visible leadership and decades of pent-up emotions… a recipe for chaos.

All of this was set against the backdrop of carrying out the other provisions of the Treaty regarding lands, ownerships, and financial assignments.  It truly was a chaotic time… and the newly formed nation was in dire need of moral leadership.

Divine providence blessed them with a cadre of men who stepped forward to guide the individual regions toward such a necessary reckoning.

 

History Repeating Itself?

Are we witnessing a repeat of this critical period? 

The similarities are striking.

  • A mistrust of Authority in general and Government specifically…
  • A disoriented, fearful, angry, and defensive citizenry…
  • Charlatans taking advantage of the disarray…
  • An ineffective Continental Congress…
  • No discernable moral, elected men to assert positive, lasting leadership.

 

Oaths and Other Binding Agreements

Civilized, sustainable societies rely on oaths and other binding agreements for both their short term and long term cooperation and success.  Without the ability to trust in verbal and written agreements, societies would collapse into bickering, chaotic entities, without any hope of inter-generational progress.

There would be no smooth transition… effectively each generation would be starting over… operating from a purely egoic/intellectual basis… where power and force dominates… which is classic shortsighted, zero-sum thinking… the stuff of tyrants and dictators.

The founders created an alternative… a spiritually guided, morally balanced approach where Trust is the key, critical component that facilitates inter-generational, positive transitions and sustainable progress.

 

Wisdom Personified

The founders were very careful and deliberate in the specificity of the structure they created.  They purposefully did not mention or assign any party identification or authority… in fact they specifically and clearly spoke out against it.  Their goal was to create a system of limited and direct involvement… a checks and balance system… so that citizens could directly control their representatives without any outside management. The same can be said for religious affiliation.  The founders specifically avoided any mention or indication of a religious loyalty test.  This wise group of men grasped the fundamental difference between external religious practice and internal Spiritual guidance.

They knew that internal spiritual guidance was the bedrock of any sustainable society. It creates the atmosphere that promotes healthy and thriving religious practices.  The cultural and social practices of their day provided all of the experiential insights necessary to promote healthy religious practice.

The founders specifically created a form of management that gave the citizen/owners direct control over their representatives.  The Federalist Papers give a glimpse into their thinking regarding these foundational issues.

 

Understanding Our Energetic Imbalance

Current American generations are being challenged unlike any in our history.  The primary challenge is the proliferation of abundant and inexpensive electronic devices that create endless distractions that interfere with our natural human need of peace, quiet, and balance.

Other challenges include dietary challenges… financial challenges… cultural challenges… social challenges… intellectual challenges… and most importantly –spiritual challenges… which portray themselves as moral decisions.

Since we are electro-chemical, biological beings… all of these challenges affect our daily functions through our perceptions, thoughts, actions, and health.

Poor diet… lack of sleep… intellectual overstimulation… and incendiary language all consciously or unconsciously affect our daily perceptions and health… which are actualized through our fight-or-flight responses… which ultimately control our metabolic processes.

It is very important to understand that this is an automatic process —as in, beyond our control.
These are evolutionarily formed fundamental, survival processes designed to protect us.

 

When our fight-or-flight response is triggered… it disrupts our normal maintenance, healing processes and focuses our energy production on the perceived threat… which —if prolonged— can lead to profound deficiencies and pave the way for chronic conditions.

For decades, I’ve used the phrase, “Your body is your scorecard”.  Your body is constantly telling you how balanced you are… in all of your processes and awareness’s.  IF we are willing and honest with ourselves, we can see signs of imbalance… we can then better understand how chronic disease contributes to feelings of malaise, dread, listlessness, and anger.

 

Regaining Personal Balance

As a living, breathing member of the current human population, you contribute to the overall energetic state of our planet.  Your accumulated thoughts and actions regarding self-care, and your energy usage choices result in the YOU that exists today… YOU are currently living the consequences of your choices.  As you become aware of imbalances in your life… YOU get to choose if it’s now time to correct them.

Humanity’s biggest collective imbalance has always been rooted in our Faith/Fear choices.

 

The survival part of our mind —our egoic mind— is where the zero-sum mentality resides.  IF nurtured on lack, loss, doubt, deprivation, and exclusion, it can conjure up some grim scenarios, which can spiral into very destructive behaviors and lifestyles.

Injecting Soul/Spirit energy into those intellectual energetic patterns can help create calm, hope, and balance.  Managing our mind better with positive Soul/Spirit energy would create a paradigm shift of epic proportions… and make our world and worldview much better.

Remember, human history is a long succession of   Generations
every generation containing   Leaders and Followers
all adhering to  Faith or Fear  decisions…
with the net result of progressing or regressing…
of producing either sustainable or unsustainable lifetimes and societies.

 

Positive inter-generational growth and progress are not guaranteed… they are the result of faith-guided trust and interactions… which can lead to a sustainable, amicable society and culture.

Our current emotional/intellectual pattern of clinging to egoically-derived, fear-laden, zero-sum practices of maligned self-centered concepts are interfering with our spiritual guidance/growth… AND, we are living the results… the increasing, energetic degradation of current American generations.

IF we let this go much longer, it will dramatically affect all living generations of our world population.  Our united States has been viewed as the defacto world leader in human rights and sanctity of life… and it’s quite evident to even the most detached Follower, that a majority of US Leaders place no importance on either human rights or the sanctity of life.

 

Hopefully, you can see that:

  • All current generations have an opportunity to come together and fix these long-ignored problems…
  • We’ve been given a gift of means and opportunity…
  • We can still be the beacon of light on our planet…
  • We can still champions human rights and the sanctity of life.
